These Terms of Service (“Terms”) govern your access to and use of the BarChannel mobile application and related services (the “Service”), provided by Liberty Edge LLC (“Liberty Edge,” “we,” “us,” or “our”). Please read them carefully.
By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
These Terms constitute an agreement between Liberty Edge LLC and you, the end user, and not between you and Apple Inc. (“Apple”). Liberty Edge LLC, and not Apple, is solely responsible for the BarChannel application, its content, maintenance, support, and any services provided through the application. Your use of BarChannel is subject to these Terms and to the applicable Apple Media Services Terms and Conditions.
Liberty Edge LLC grants you a limited, non-exclusive, non-transferable, revocable licence to use the BarChannel application on any Apple-branded products that you own or control, as permitted by the Usage Rules set out in the Apple Media Services Terms and Conditions.
Liberty Edge LLC is solely responsible for providing maintenance and support services for the application. Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the application.
Liberty Edge LLC is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the application to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the application, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty will be the sole responsibility of Liberty Edge LLC.
Liberty Edge LLC, and not Apple, is responsible for addressing any claims by you or any third party relating to the application or your possession and use of it, including but not limited to product liability claims, any claim that the application fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection, privacy or similar legislation.
If a third party claims that the application or your possession and use of it infringes that third party’s intellectual property rights, Liberty Edge LLC, and not Apple, is solely responsible for the investigation, defense, settlement and discharge of any such claim.
You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
You must comply with any applicable third party terms of agreement when using the application.
Apple and Apple’s subsidiaries are third party beneficiaries of these Terms. Upon your acceptance of the terms and conditions of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third party beneficiary of these Terms.
BarChannel helps bars, lounges, and sports venues identify which TV channel or streaming service is airing live sporting events, based on the cable, satellite, and streaming providers and the ZIP code you configure. The Service includes channel lookup, availability indicators, multi-TV planning, printable schedules, and game notifications.
You must be at least 18 years old and authorized to enter into these Terms on behalf of yourself or the business you represent. The Service is intended for commercial use by venues and their staff, not for personal or household use.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate information and to keep it current. Notify us promptly of any unauthorized use of your account. We may suspend or terminate accounts that violate these Terms.

The Service, including its software, design, text, graphics, and the BarChannel name and logo, is owned by Liberty Edge LLC and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your internal business purposes during your subscription.
Team, league, network, streaming service and television provider names and marks referenced within the Service are the property of their respective owners and are used for identification purposes only. Liberty Edge LLC is not affiliated with, endorsed by, or sponsored by any league, team, broadcaster, streaming service or television provider.
The Service relies on and may link to third-party services (including app stores, data providers, and infrastructure providers). We are not responsible for the content, policies, or practices of third parties, and your use of them may be subject to their separate terms.
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that the data provided will be accurate or complete.
To the maximum extent permitted by law, Liberty Edge LLC and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim arising out of or relating to the Service will not exceed the amount you paid us for the Service in the twelve (12) months preceding the claim, or one hundred U.S. dollars (USD $100), whichever is greater.
You agree to indemnify and hold harmless Liberty Edge LLC and its officers, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your use of the Service, your violation of these Terms, or your violation of any law or the rights of any third party, including any broadcast or licensing rights.
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Upon termination, your right to use the Service ends, though provisions that by their nature should survive (including ownership, disclaimers, limitation of liability, and indemnification) will continue to apply.
These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the state and federal courts located in Pennsylvania, unless otherwise required by applicable law.
We may modify these Terms from time to time. When we do, we will update the “Last updated” date above and, where appropriate, notify you within the app. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
